These terms govern access to and use of curviocheerdck.com, operated by Curvio Cheerdck Publications Ltd.

Acceptance of terms

By accessing curviocheerdck.com ("the Site"), the user agrees to be bound by these Terms of Service and by the Privacy Policy and Cookie Policy, which are incorporated by reference. The Site is operated by Curvio Cheerdck Publications Ltd, company number 13847221, registered at 14 Ashworth Lane, Cambridge CB2 1TN, United Kingdom ("the Company"). A user who does not accept these terms must not use the Site.

Nature of the content

The Site publishes a referenced survey of research in quantum technology, fusion energy and dark-matter physics. The content is provided for general information and scholarly reference. It does not constitute investment, engineering, legal or procurement advice, and no decision should be made in reliance on it without independent verification of the primary sources cited. Pricing, specifications and schedules quoted from third parties reflect the sources at the date of access indicated and may have changed.

User obligations

The user agrees not to: (a) access the Site by automated means that impose unreasonable load on the Company's infrastructure; (b) attempt to circumvent security measures or gain unauthorised access to servers or data; (c) use the contact form to transmit unlawful, defamatory, infringing or unsolicited commercial material; (d) misrepresent the user's identity or affiliation in correspondence with the Company; or (e) reproduce the Site's content in a manner that removes attribution or falsely implies endorsement by the Company.

Intellectual property

The text, tables, figures, design and code of the Site are the property of the Company or its licensors and are protected by copyright and database rights under the laws of the United Kingdom and international treaties. Short extracts may be quoted for the purposes of criticism, review or scholarly citation with attribution to curviocheerdck.com. Any other reproduction, distribution or creation of derivative works requires the Company's prior written permission. Photographs served from third-party image services remain the property of their respective owners. The names of journals, laboratories, companies and products mentioned in the content are the trade marks of their owners and are used for identification only.

The Site links to journal articles, preprint servers, laboratory websites, standards bodies and commercial rate cards. Those resources are controlled by third parties. The Company does not endorse them, is not responsible for their content or availability, and makes no representation as to the accuracy of material accessed through them. Following an external link is at the user's own risk and subject to the terms of the destination site.

Disclaimer of warranties

The Site and its content are provided on an "as is" and "as available" basis. To the fullest extent permitted by law the Company disclaims all warranties, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose and non-infringement. The Company does not warrant that the Site will be uninterrupted or free of errors, or that defects will be corrected.

Limitation of liability

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot lawfully be excluded. Subject to that, the Company shall not be liable to any user for any indirect, consequential, special or punitive loss, for loss of profit, revenue, data or goodwill, or for any loss arising from reliance on the content of the Site, whether in contract, tort (including negligence), breach of statutory duty or otherwise. The Company's total aggregate liability to any user in connection with the Site shall not exceed one hundred pounds sterling (GBP 100).

Indemnity

The user agrees to indemnify the Company, its officers and employees against all claims, losses and reasonable costs arising from the user's breach of these terms or misuse of the Site.

Termination

The Company may suspend or terminate access to the Site, in whole or in part, for any user who breaches these terms or whose conduct the Company reasonably considers harmful to the Site or to other users, without notice and without liability. Sections 4 through 11 survive termination. The Company may also discontinue the Site or any part of it at any time.

Governing law

These terms and any dispute or claim arising out of or in connection with them or the Site are governed by and construed in accordance with the law of England and Wales. Consumers resident in other jurisdictions retain the benefit of any mandatory protections of the law of their country of residence.

Dispute resolution

The parties shall first attempt to resolve any dispute through written correspondence addressed to [email protected]. If the dispute is not resolved within 30 days, either party may refer it to the courts of England and Wales, which have exclusive jurisdiction subject to the consumer protections referred to above. The European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr is available to consumers resident in the European Union.
